TERMS AND CONDITIONS

AGREEMENT TO OUR LEGAL TERMS
We are Digitize Jamaica Ltd, doing business as Island Task (“Company,” “we,” “us,” or “our”), a company registered in Jamaica at 60 Knutsford Boulevard, 9th floor, PanJam Building, Kingston, Jamaica.

We operate the website https://www.islandtask.com (the “Site”) and the Island Task mobile application (the “App”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

Island Task is an online marketplace that connects individuals and businesses with trusted local service providers across Jamaica. Whether you're looking for cleaning, beauty, errands, or handyman help, Island Task makes it easy to discover, evaluate, and book professionals near you. We provide tools to facilitate secure payments, transparent reviews, real-time scheduling, and direct communication.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Island Task, concerning your access to and use of the Services. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Legal Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM USING THE SERVICES.

We may revise these terms from time to time. The updated version will be indicated by an updated “Last updated” date and will be effective as soon as it is accessible. Your continued use of the Services constitutes your acceptance of any revised terms.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

We recommend printing a copy of these Legal Terms for your records.

1. OUR SERVICES
Island Task provides an on-demand platform where customers can discover, request, and book services from independent providers across Jamaica. These services include, but are not limited to, home cleaning, handyman help, personal errands, beauty services, moving assistance, and more.

Island Task does not employ service providers but acts solely as a marketplace and facilitator. All providers on our platform are independent contractors and are responsible for the quality, safety, and legality of their services.

Use of the Services is at your own risk, and it is your responsibility to vet the qualifications and reviews of any provider you hire through Island Task.

Island Task makes no warranties as to the suitability or availability of any service provider or the outcome of any service requested through our platform.

2. INTELLECTUAL PROPERTY RIGHTS
Island Task owns or licenses all intellectual property rights in the Services, including all content, trademarks, graphics, software, and service functionalities. These are protected by applicable copyright and trademark laws.

You are granted a limited, non-exclusive license to access and use the Services for personal or internal business purposes only. Any unauthorized use, reproduction, or distribution of our content or software is strictly prohibited.

3. USER REPRESENTATIONS
By using the Services, you represent and warrant that:

  • You are at least 18 years of age.

  • All registration information submitted is accurate and will be kept up to date.

  • You will not use the Services for unlawful or unauthorized purposes.

  • You will not violate any applicable law or regulation.

If any information provided by you is false or incomplete, we reserve the right to suspend or terminate your access to the Services.

4. USER REGISTRATION
You may be required to register to access certain features of the Services. You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.

Island Task reserves the right to remove or modify usernames that are inappropriate or infringe on third-party rights.

5. SERVICE LISTINGS
Service providers are responsible for accurately listing the services they offer, including descriptions, pricing, availability, and any necessary qualifications. Listings must be clear, honest, and comply with all applicable laws and Island Task's guidelines.

Island Task may, at its discretion, edit or remove listings that are misleading, inappropriate, or violate our terms. Providers are solely responsible for keeping their listings up to date.

6. BOOKINGS AND PAYMENT
Island Task facilitates bookings between users and service providers via the platform. Once a booking is confirmed, payment is securely processed through our integrated payment system.

All users agree to provide accurate and current payment information. Charges will be displayed prior to confirming a booking, and your selected payment method will be charged accordingly.

Island Task holds payments in escrow until the service is completed. Once the service is marked as complete, funds (minus Island Task’s commission) are released to the provider.

7. SUBSCRIPTIONS
Island Task may offer premium features or plans for service providers and users through paid subscriptions. These subscriptions will auto-renew unless cancelled prior to the next billing cycle.

We may offer free trials or promotional periods, after which standard charges will apply. Subscription details, including pricing and cancellation options, are available in your account settings.

8. CANCELLATION AND REFUNDS
Users may cancel a service request prior to the provider beginning the task. In such cases, a full or partial refund may be issued depending on timing and provider policies.

If a provider cancels, Island Task will assist the user in finding a replacement or issuing a refund.

All refund requests must be submitted within 48 hours of the issue via email to hello@islandtask.com. Decisions will be made at the sole discretion of Island Task based on available evidence.

9. PROHIBITED ACTIVITIES
You agree not to engage in any of the following prohibited activities:

  • Misrepresenting your identity or qualifications.

  • Providing or soliciting illegal services.

  • Circumventing platform fees or encouraging off-platform transactions.

  • Posting false, misleading, or defamatory content.

  • Using automated scripts or bots to interact with the platform.

  • Engaging in harassment, threats, or discrimination.

Island Task reserves the right to suspend or terminate accounts that violate these rules.

10. USER CONTRIBUTIONS
Island Task may allow users to submit content such as reviews, comments, and photos. By submitting content, you grant Island Task a non-exclusive, royalty-free license to use, reproduce, and display the content in connection with the Services.

You are solely responsible for your content and agree not to post anything unlawful, offensive, or infringing. We reserve the right to remove any content at our discretion.

11. CONTRIBUTION LICENSE
By posting your Contributions on Island Task, you grant us an unrestricted, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your content in connection with operating and marketing our platform.

You retain ownership of your content, but you waive any claims that our use infringes your rights. We are not obligated to compensate you or provide credit for use of your Contributions.

12. REVIEW GUIDELINES
Island Task values honest and respectful feedback. When posting reviews, you agree that:

  • You have direct experience with the service being reviewed.

  • Your review is accurate and not misleading.

  • You will not post offensive, defamatory, or discriminatory content.

  • You are not reviewing in exchange for compensation.

We reserve the right to remove reviews that violate these guidelines or our terms.

13. MOBILE APP LICENSE
Subject to your compliance with these terms, Island Task grants you a limited, non-transferable, revocable license to download and use the App on your personal device.

You agree not to:

  • Reverse engineer or modify the App.

  • Use the App for illegal or unauthorized purposes.

  • Share your login with others.

  • Violate the intellectual property rights of Island Task or third parties.

Island Task reserves the right to update or remove the App without notice.

14. THIRD-PARTY LINKS
Island Task may include links to third-party websites, apps, or services. These are provided for convenience only and are not under our control.

We are not responsible for any content, services, or products offered by third parties. Your interactions with third-party sites are solely between you and the third party, and you access them at your own risk.

15. ADVERTISING
Island Task may allow third-party advertisers to display ads on the platform. We do not endorse or take responsibility for any claims or products featured in those ads.

You acknowledge that any dealings with advertisers found on the platform, including payment or participation in promotions, are solely between you and the advertiser.

16. PLATFORM MANAGEMENT
Island Task reserves the right to monitor, modify, or remove content, users, and activities that violate these terms or impact the quality of the platform. This includes, but is not limited to:

  • Suspending or terminating user accounts.

  • Editing or removing service listings, reviews, or contributions.

  • Investigating reported behavior and taking appropriate action.

We are not obligated to monitor all activity but may take enforcement actions as needed to maintain platform integrity.

17. PRIVACY POLICY
We take privacy seriously. Our Privacy Policy explains how we collect, use, and protect your data when you use Island Task. By using the platform, you consent to our data practices.

18. COPYRIGHT INFRINGEMENTS
If you believe any content on Island Task infringes your copyright, please notify us at hello@islandtask.com with a detailed description of the alleged violation, your contact information, and evidence of ownership.

We will promptly investigate and take action, which may include removing or disabling access to the infringing material.

19. TERMINATION
We reserve the right to suspend or terminate your access to Island Task at our sole discretion, with or without notice, for any reason including violation of these terms, misuse of the platform, or illegal activity.

If your account is terminated, you may not re-register under a different name or identity without our permission. We also reserve the right to pursue legal action as needed.

20. MODIFICATIONS AND INTERRUPTIONS
We may update, change, or suspend portions of Island Task without notice. We do not guarantee uninterrupted access to the Services and are not liable for any disruptions, delays, or downtime.

We are also not responsible for any loss or inconvenience caused by system maintenance, technical issues, or unexpected outages.

21. GOVERNING LAW
These terms are governed by and interpreted in accordance with the laws of Jamaica. Any disputes shall be resolved exclusively in the courts located in Kingston, Jamaica.

22. DISPUTE RESOLUTION
Before initiating legal action, both parties agree to first attempt to resolve disputes informally by contacting the other party. If unresolved within 30 days, either party may pursue formal dispute resolution through binding arbitration or court proceedings, as applicable under Jamaican law.

23. CORRECTIONS
There may be information on the Island Task platform that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct or update any such information without prior notice.

24. DISCLAIMER
Island Task provides the platform and Services “as-is” and “as available.” We do not guarantee uninterrupted access or that all services booked through the platform will meet your expectations.

To the fullest extent permitted by law, Island Task disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

25. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Island Task and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services.

Our total liability to you for any claim arising out of your use of the platform will not exceed the total amount paid by you, if any, to Island Task in the previous six months.

26. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Island Task, its affiliates, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, or expenses (including legal fees) resulting from: (1) your use of the Services; (2) your violation of these Terms; (3) your violation of any third-party right; or (4) any content you submit through the platform.

27. USER DATA
Island Task retains the right to maintain data related to your use of the Services for business and legal purposes. While we take standard precautions to protect this data, you are solely responsible for any data you transmit or store using our Services. We are not liable for any loss or corruption of user data.

28. ELECTRONIC COMMUNICATIONS
By using Island Task, you consent to receive electronic communications from us, including notices, agreements, disclosures, and other communications. You agree that all communications we provide electronically satisfy any legal requirement that such communications be in writing.

29. SMS MESSAGING
If you opt in to receive SMS messages, you may receive updates, promotions, or alerts related to your Island Task activity. You can opt out at any time by replying STOP. Message and data rates may apply depending on your mobile carrier.

30. JURISDICTION NOTICES
Island Task operates under Jamaican law. If any provision of these Terms is found to be unenforceable under Jamaican or local law, the remaining provisions shall remain in effect.

31. MISCELLANEOUS
These Terms, along with our Privacy Policy and any other legal notices published by Island Task, constitute the entire agreement between you and us. Failure to enforce any right shall not be deemed a waiver. If any provision is found to be invalid, the remainder shall remain in full force and effect.

You may not assign or transfer your rights under these Terms without our prior written consent.
